With years of experience representing clients before the Internal Revenue Service (IRS), I have consistently heard the same complaints about the IRS from clients and fellow tax professionals. The biggest complaint I receive from clients and colleagues is the inability to reach a “live person” by telephone at the IRS. Even if you can speak with someone at the IRS, the next challenge is whether they can help with your tax issue. The next prevalent complaint is the processing time for tax returns submitted to the IRS. Lastly, the final major complaint I hear is the delay in the IRS finalizing resolutions.
The following outlines these three complaints in detail and how the team of J. David Tax Law attorneys collaborate to overcome them and provide the satisfaction they deserve.
If you visit the IRS website or read any of their press releases you might think that their goal is to make communication with them easier for the everyday taxpayer. However, I cannot even begin to count the number of times I have had new clients with tax issues whose primary complaint was that they could never reach anyone at the IRS. Although it has always been difficult to reach a live agent at the IRS to discuss a simple tax matter, the amount of complaints that I have seen regarding hold times and an inability to speak with someone who can help has grown exponentially over the last several years. It feels as if it is impossible for the everyday taxpayer to contact the IRS and resolve their own tax matters.
Unfortunately, long telephone hold times and inexperienced IRS agents also negatively impact the ability of tax professionals to resolve tax matters for their clients. I cannot even count the number of times colleagues, here at J. David Tax Law and other firms, have expressed their frustrations about the logistical roadblocks in place that prevent what should be quick and easy communication with the IRS. These complaints have only increased over the last several years.
The IRS often promotes the number of new hires they have or plan to add to their organization, but what they do not often promote is the inexperience the newly hired personnel possess, and the amount of time needed to properly train these individuals to properly handle various types of cases. Many times, my colleagues and I at J. David Tax Law have spoken with an IRS agent who has yet to be trained in the subject material that we are calling to discuss.
At J. David Tax Law, we work to overcome these communication issues by working collaboratively to figure out different methods to maneuver around these roadblocks. My fellow attorneys and I have been able to navigate the IRS phone systems to reach IRS agents quicker so that we can effectively and expeditiously represent our clients. Opportunely, our clients at J. David Tax Law have the benefit of working with an experienced group of attorneys who work collaboratively and who can find solutions. However, quick and easy communication with the IRS should be the standard, and not the exception.
Although the IRS has worked to reduce their processing time of tax returns, slow tax return processing continues to be a major complaint from both clients and fellow tax professionals. For 2023 Tax Returns, the IRS indicated that most refunds would be issued in less than 21 calendar days. Although three (3) weeks seems reasonable, this is not always the actual time. For example, if you prepare and mail in your own return, it could take “four weeks or more” according to information on the IRS website. What’s worse is that if the IRS decides to review your tax return for any reason, it could take several months to receive your refund.
The other major complaint about tax return processing time that I often experience is the impact of delayed processing of returns for taxpayers who owe the IRS a balance on the return. Unfortunately, taxpayers sometimes fall behind on their returns or, worse yet, end up owing the IRS. They try to do the right thing by contacting a tax professional for help. They will get their returns prepared and send them to the IRS. Then they must wait months for the IRS to process their returns. If they owe a balance on the return, the longer it takes the IRS to process, the more penalties and interest accrue. If the taxpayer is not able to pay the balance in full and needs a payment agreement, they are often unable to establish one until the returns have finished processing. This may then lead to additional penalties and interest the taxpayer was not prepared for.
Since our attorney team works collaboratively at J. David Tax Law, we ensure we are doing everything we can to guarantee our clients’ tax returns are processed as quickly as possible. We place follow-up calls using various tactics to speak with the correct personnel at the IRS who can provide us with proper updates. Just like the communication issues discussed earlier, a systemic delay in tax return processing can drastically and negatively impact taxpayers just trying to do the right thing.
The final complaint that I often hear from clients and colleagues alike is the time it takes to establish a resolution with the IRS when there is a balance due. First, you must get through to an agent at the IRS. Then you must hope they can actually work with you to establish a resolution.
Once we can speak with an IRS agent that can assist with establishing a resolution, there is no guarantee that it will be set up properly by them. In many cases, the IRS agent we speak with must submit the proposed resolution to their manager who then must review it and make a final determination. Yet again, I cannot begin to count the number of times my colleagues and I have called back to find out that the proposal we submitted was either not submitted to or never reviewed by a manager.
